1. Enrolment in the Program
An application to join the Fun Digital Affiliate Program is accepted in good faith on the proviso that your web site is not
unsuitable for the Program.
Unsuitable sites include those that:
- promote sexually explicit materials
- promote violence
- promote discrimination based on race, sex religion, nationality, disability, sexual orientation or age
- promote illegal activities
- otherwise violate intellectual property rights
All sites will be reviewed on a regular basis and should it be determined (at our sole discretion) to be unsuitable for the Program, we may terminate this Agreement and withdraw your membership of the Program.
2. Links on Your site
You may select one or more links to list on your site or use in emails. These links may be text or graphics and link directly to Fun Digital's home page, a category or to a specific product listed on our site. For each link selected you will display the content and details as provided to you by us. You may add or delete links from your site at any time without our approval. No amendments, additions or alterations may be made to the details provided by us.
3. Order Processing
We will process orders placed by customers who follow the links from your site to our site. We reserve the right to reject orders that do not comply with our normal Trading Terms and Conditions or any other requirements we may establish periodically. We will be responsible for all aspects of order processing and fulfilment.
4. Qualifying Product
Products that are eligible to earn commission are referred to as Qualifying Product. For a product sale to be eligible for commission the customer must click-through a Link from your site to our site. We will only pay commission on such Products after order, payment and shipping have been confirmed and after the 7 day return period as laid down in the EEC Regulations for Direct Selling.
5. Qualifying Revenue
this is revenue by us from sales of Qualifying Products, excluding costs for any additional carriage, small order charges and any other special charges that are made in accordance with our normal terms of trading. The current commission rate is 15% of Qualifying Revenue from sales of all Qualifying Products (except as noted above). The commission shown as earned will be inclusive of VAT where appropriate. Additional rates may be introduced from time to time at our discretion without prior notice.
6. Commission Payment
We will pay commission on a quarterly basis. All payments will be made approximately 30 days following the end of the qualifying quarter according to the terms and conditions of this document. Payments to you will not be rendered for amounts less than 30.00 GBP. When your affiliate account total reaches 30.00 GBP or more at the end of any given quarter (Jan-Mar; Apr-Jun; Jul-Sep; Oct-Dec), you will receive payment via your nominated method which will either be via direct debit to a UK bank account or via your PayPal account.
7. VAT
As the commission is calculated automatically on the price shown on the site VAT has already been included in the amount payable. If you are VAT registered you must notify us by email of your VAT number once you have registered with the Fun Digital Affiliate Program. The statement of commission will show the breakdown between net commission and VAT at the rate currently applicable.
8. Policies and Pricing
Customers who buy products through this Program will be deemed to be customers of Fun Digital Ltd. Accordingly, all Fun Digital’s rules, policies and operating procedures concerning customer orders, customer service and product sales will apply to those customers. We may change our policies and operating procedures at any time. For example, we will determine the prices to be charged for products sold under this program in accordance with our own pricing policies. Product prices and availability may vary from time to time. Any price changes will automatically update any links. We will use every reasonable effort to present accurate information but cannot guarantee the availability or price of any particular product.
9. Limited Licence
We grant you a non-exclusive, revocable right to use the graphic images and text described in Section 2. You may not modify the graphic image or text in any way. We reserve all of our rights in the graphic image and text, any other images, our trade name and trademarks, and all other intellectual property.
Fun Digital Ltd/fundigital.co.uk will own all right, title and interest in and to all information that is created or collected in the operation of the Fundigital Ltd/fundigital.co.uk Web site and reserves the right to amend or terminate this Agreement at any time, with or without notice to you.
10. Tracking
When a web surfer clicks through your affiliate link, a cookie is set in their browser
that contains your affiliate username. Also, their IP address is tracked in the database
along with your affiliate name. When this person decides to buy a product, the script will
look for this cookie and/or try to match their IP address to identify the affiliate who
will be awarded the commission. Visitors sent through your affiliate link may make a purchase
later in time and the commission will still be awarded if the cookie is present in their browser
and/or they are using the same IP address as the one logged in the database.
11. Liability
We will not be liable for indirect or accidental damages (loss of
revenue, commissions) due to tracking failures, loss of database files,
and any results of "intents of harm" to the Program or our website. We do not make
any expressed or implied warranties with respect to the Fun Digital Affiliate Program and/or
products sold at this site. We make no claim that the operation of the Fun Digital Affiliate Program
and our website will be error-free and we will not be liable for any interruptions or errors.
You shall indemnify and hold Fun Digital Ltd/fundigital.co.uk harmless from any and all legal
actions, damages or liabilities incurred from the day-to-day operations of you, the Applicant. Under
no circumstances will Fun Digital Ltd/fundigital.co.uk be liable whether in tort, contract or otherwise
for indirect, incidental, consequential, special or exemplary damages (including but not limited
to damages for any loss of revenue, profits, business interruption, loss of business information
or data, loss of goodwill, work stoppage, hardware or software failure, or other pecuniary loss)
arising from or relating to any provision of this Agreement or the Program. Without limiting the
foregoing, Fun Digital Ltd/fundigital.co.uk aggregate liability arising with respect to this Agreement will
not exceed the total fees paid or payable to you under this agreement.

will own all right, title and interest in and to all information that is created or collected in
the operation of the Fun Digital Ltd/fundigital.co.uk Web site and reserves the right to amend or terminate
this Agreement at any time, with or without notice to you.
12. Terms of the agreement
This agreement will begin upon your acceptance of the Terms and Conditions of the Fun Digital Affiliate Program and will continue as long as your site continues to qualify or until we terminate your participation in the Program.
The terms of this agreement may be modified by us at any time. If any modification to the terms
is unnacceptable to you, your only choice is to terminate your AFFILIATE account.
Your continuing participation in the program will constitute your acceptance of any change.
13. Miscellaneous
This Agreement will be governed by UK law and applies to the applicant of the Program and Fun Digital Ltd only.
